When an estate or trust is established, many people incorrectly believe that the appointed executor or trustee has complete authority to do whatever he or she desires in administering the estate/trust. This is not the case. Beneficiaries have significant rights; the overseeing executor or trustee owes a “fiduciary duty” to those beneficiaries, to act in the beneficiaries’ best interest, and to provide information (such as accountings) at reasonable intervals, if requested. Beneficiaries may not be kept in the dark.

At Bennett Law LLC, we regularly represent beneficiaries to advise them regarding these rights, and to enforce them as against the executors or trustees who owe the beneficiary timely information and transparency. If you feel you are not being treated fairly by an executor or trustee, schedule an initial consultation with a lawyer at 732-268-7520 or contact the office online.
